The present article aimed to analyze the role of the school in the construction of a more humane and equitable education, examining the articulation between legal foundations, institutional reorganization, and the centrality of the pedagogical relationship. The study addressed the problem of the insufficiency of formal equality within educational systems and investigated how the school institution could effectively implement the educational right through practices oriented toward social justice and the integral development of students. Methodologically, a qualitative bibliographic research was conducted, based on systematic reading, careful selection, thematic organization, and interpretative analysis of reference books and scientific articles in the field of Education, enabling a critical dialogue among different theoretical perspectives. The results indicated that the universalization of access did not, by itself, ensure equity in educational processes, making it necessary to revise assessment practices, implement redistributive measures, and value the ethical dimension of teaching practice. It was concluded that promoting an education committed to students’ dignity and pedagogical responsibility required the integration of legal principles, institutional transformation, and relational commitment, thereby reaffirming the social function of the school in reducing educational inequalities.
