Abstract

The Question of Order is a relevant instrument within the Brazilian legislative process, functioning as an internal control mechanism aimed at preserving procedural regularity. This paper analyzes the raising of the Question of Order as a guarantee of due legislative process, considering its constitutional basis, its regulation in the internal rules of legislative bodies, and its relationship with the legitimacy of enacted norms. The study adopts a qualitative approach, based on bibliographic review and documentary analysis, including constitutional provisions, internal rules, and decisions of the Brazilian Supreme Federal Court. The findings indicate that the proper use of the Question of Order allows the correction of procedural flaws within the legislative arena itself, strengthening legal certainty and democratic legitimacy.
