LEGAL CERTAINTY AND ITS EFFECTIVENESS FOR THE SUSTAINABILITY OF THE SOLIDARITY ECONOMY IN THE AMAZON

This article analyzes Legal Certainty as a structural element for the effectiveness of the Solidarity Economy (SE) in the Amazon, investigating how Solidarity Economic Enterprises (SEEs) can access public policies, stabilize their legal relations, and strengthen their internal governance. The research stems from the problem of normative and operational fragility faced by SEEs in the face of institutional, contractual, and compliance demands, especially in territories where informality is high. A qualitative methodology is used, based on a bibliographic review, documentary analysis of applicable norms, and a critical study of the legal instruments that affect the operation of SEEs. It examines the impact of Law No. 15,068/2024 (Sinaes) and its interfaces with federal regulatory frameworks, such as Law No. 13,019/2014, which governs partnerships with civil society, and Law No. 14,133/2021, which regulates public procurement, identifying how these norms increase the predictability of legal relations necessary for accessing financing, public purchases, and institutional cooperation. The relevance of alternative dispute resolution mechanisms, provided for in Laws No. 13,140/2015 and No. 9,307/1996, and the importance of intellectual property protection, according to Law No. 9,279/1996, are also addressed to mitigate patrimonial risks and consolidate the productive identity of SEEs. It is concluded that legal certainty depends on the institutionalization of specialized advice, the strategic use of the already available legal framework, and the adoption of continuous compliance practices, indispensable elements for consolidating the SE as a model for sustainable development and economic sovereignty in the Amazon.
