NEURORIGHTS AND DIGITAL CHILDHOOD: CHALLENGES TO THE BRAZILIAN LEGAL SYSTEM

This paper analyzes and discusses neuro-rights as a new category of fundamental rights to be protected, especially in the context of digital childhood. With their fingers on the buttons of electronic devices and under strong audiovisual stimulation, children become consumers and producers of content on the same digital platforms used by adults in all their diversity. The partial or total lack of monitoring of children's activities on digital platforms raises a series of questions about ethics, network regulation, and civil liability. In this context, the analysis of the Brazilian legal system revealed legislative insufficiency regarding the classification and accountability for violations of children's neuro-rights. Therefore, addressing this topic is necessary in order to contribute to the improvement of public policies developed for the well-being of children and, likewise, to the improvement of the legal system, with a view to civil liability for violations of children's neuro-rights.
