Abstract

This study explores the topic of Intellectual Property Protection in Brazil, addressing an analysis of the Brazilian reality. This theme represents ways to stimulate innovation, economic competitiveness, and technological development in the country, being mainly based on Laws No. 9.279/96 (Industrial Property) and No. 9.610/98 (Copyright), in which Brazilian legislation seeks to ensure the rights of inventors, authors, and companies over their intellectual creations. Brazil is part of important international agreements, such as the Paris Convention, the Berne Convention, and the TRIPS Agreement, which reinforces its commitment to global standards of intellectual property protection. The responsible institutions, such as the INPI (National Institute of Industrial Property) and the National Library, play a crucial role in the registration and monitoring of these rights. However, the Brazilian system still faces significant challenges, such as delays in registration processes, a scarcity of resources for monitoring, and widespread ignorance among the population and entrepreneurs regarding the importance of intellectual property protection. In this case, examples such as piracy, illegal copying of works, and the misuse of trademarks and patents remain common and harmful practices. Therefore, this project aims to propose measures such as the digital modernization of registration systems, the expansion of intellectual property education, and the institutional strengthening of competent bodies. Although Brazil has a basic and logical structure for the proper application of the law, the effective protection of intellectual property still depends on structural and cultural improvements. Strengthening this system is essential for the country to fully enjoy the benefits of technological innovation, creativity, and especially competitive insertion in the global arena.
