WORKERS' MENTAL HEALTH AND EMPLOYER RESPONSIBILITY: THE COMPANY'S DUTY TO PREVENT PSYCHOLOGICAL DISORDERS

Workers' mental health has gained increasing relevance in the legal and social spheres, especially given the increase in cases of psychological disorders resulting from unhealthy work environments, where pressure to meet targets, exhausting work hours, bullying, and a lack of institutional support policies constitute risk factors that directly impact employees' emotional well-being. This highlights the employer's responsibility to implement preventive measures, psychological support programs, and dignified working conditions that ensure not only physical integrity but also psychological well-being, respecting the principles of human dignity and the value of work. Given this context, the objective of this study is to analyze the employer's legal responsibility in preventing mental disorders in the workplace, adopting a literature review of relevant authors and standards as a methodology. The preliminary conclusion is that promoting mental health in the workplace should not be seen as a differential, but rather as a legal and ethical duty of organizations.
