This study aims to analyze cybercrimes and the limits of freedom of expression in the digital environment, in light of current Brazilian legislation and recent jurisprudential understandings. The expansion of communication technologies and social networks has brought significant advances, but also new legal challenges, especially regarding the protection of honor, privacy, and information security. In this context, it is essential to understand how the Brazilian State has sought to balance the fundamental right to freedom of expression with the need to curb illegal practices in the virtual environment. The research, qualitative in nature and based on the deductive method, is a bibliographical and documentary review using scientific articles, doctrines, and case law published between 2020 and 2025. It concludes that although freedom of expression is a constitutionally guaranteed right, its limits arise when other fundamental rights are violated, and the State must regulate the digital space in a democratic and proportional manner.
