This article address the secularity of the State in the Brazilian legal system, analyzing the implications of the separation between religion and public institutions, as provided for in the 1988 Federal Constitution. The main objective is to understand the limits and possibilities of this secularism in the legal context, observing its interactions with religious freedom and the right to equality. The research will be conducted through bibliographical analysis, addressing doctrines, legislation, and case law related to the topic, in order to understand the impacts of judicial decisions on secularism. The study seeks to demonstrate how secularism is applied in Brazil, highlighting the difficulties and solutions to the challenges faced in practice.
