NEW BIDDING LAW: THE ROLE OF CONSULTING IN OVERCOMING PUBLIC MANAGEMENT CHALLENGES

The New Public Procurement and Contracts Law (Law No. 14.133/2021) represents a transformation in the public procurement regime in Brazil, replacing previous regulations and introducing mechanisms to improve efficiency, transparency, and control in bidding processes. The study investigates the main challenges faced by public managers in implementing the new legislation, highlighting difficulties such as the need for continuous training, technological adaptation, and resistance to organizational change. Specialized consultancy emerges as a strategic tool to support public management in adapting to new legal requirements, offering technical support, training, and governance and compliance practices. Based on a bibliographic review and documentary analysis, strategies were identified to overcome these obstacles, such as training programs, modernization of electronic bidding systems, and encouraging the exchange of experiences among public agencies, with the support of qualified consultancies. The research highlights best practices adopted by municipalities such as Curitiba and São Paulo, which invested in the digitization of bidding processes and centralized purchasing to optimize resources and ensure greater transparency. The results indicate that the new legislation represents a significant advancement in public management, provided that it is accompanied by structural investments, professional training, and qualified consulting support. The effectiveness of Law No. 14.133/2021 depends on the implementation of governance, auditing, and compliance strategies to ensure greater predictability and legal certainty. It is concluded that collaboration among managers, suppliers, control bodies, and specialized consultancies is essential to consolidate changes and promote a more efficient procurement environment aligned with international best practices.
