This article's main objective is to analyze the application of civil law in the face of digital inheritance through a historical bibliographic analysis and using the descriptive and explanatory method. To better understand the topic, the topic was broken down through several articles regarding what digital inheritance actually is and, then, demonstrating how Brazilian legislation can be applied in order to clarify whether it is in fact self-sufficient to resolve the jurisprudential issues relating to the matter. This is a literature review, in which the Revista Ibero-Americana de Humanidades, Ciências e Educação and Scielo databases were used with the descriptors “digital inheritance”, “Brazilian legislation” and “inheritance law”. As inclusion criteria, articles published between 2015 and 2025, in Portuguese and English, available free of charge, were used. The exclusion criteria were duplicate.
