THE MAIN CHALLENGES OF THE JUDICIARY IN THE IMPLEMENTATION OF ARTIFICIAL INTELLIGENCE: ENSURING TRANSPARENCY AND IMPARTIALITY IN AUTOMATED DECISIONS

This article examines the challenges and problems faced by the Judiciary in adopting artificial intelligence (AI), with a focus on transparency and impartiality in automated decisions. The study seeks to understand the ethical and operational effects of AI in judicial proceedings, investigating the benefits and risks of its application. As a general objective, it proposes to analyze the impact of AI on the efficiency and quality of judicial decisions, while the specific objective is to identify possible biases and limitations of the algorithms used. The research uses a bibliographic review and content analysis in academic articles, institutional content and electronic journals in the legal field. The results suggest that, although AI has the potential to optimize the progress of processes and reduce the backlog of cases, concerns remain regarding the opacity of algorithms and the risk of bias. It is concluded that, for an ethical implementation of AI, it is necessary to monitor the technological tool and its use in the judicial system, ensure fair decisions and encourage the search for innovative solutions that guarantee the effectiveness of the law and the preservation of democratic principles.
