This paper examines Big Techs' accountability in combating cybercrimes, balancing digital freedom of expression with harm prevention. It identifies gaps in current legislation and proposes a regulatory model avoiding both over-censorship and impunity. The methodology analyzes case law (Brazilian STJ/STF courts), comparative legislation (EU Digital Services Act), and doctrine. Findings suggest hybrid regulation combining auditable self-regulation with proportional sanctions to ensure democratic digital spaces.
