FEMICIDE: THE STATE’S FAILURE ALLOWS IT TO HAPPEN

Femicide, a crime that is often the last act resulting from domestic violence and gender-based violence, has reached alarming rates in Brazil. The fact that Brazil ranks 5th in the world ranking of violence against women resulting in death, according to data from Agência Patrícia Galvão, reinforces the fact that the Brazilian State, through its actions to combat femicide, has increasingly shown itself to be ineffective, as it is unable to protect victims, thus reproducing a feeling of impunity. Given this occupation, the world ranking clearly shows that even if the State invests in creating legislation to try to protect these victims, it is not successful in this feat. When the State invests its efforts in making the aggressor pay for his crime, it ends up creating a false sense of security and state protection, aiming to maintain social order, demonstrating to society that it cares about these women and that it works in their favor, when the reality is far from all of this. The objective of this work is to demonstrate throughout its development the State's failure in this mission of protecting and welcoming these victims. To this end, contemporary authors such as Soraia Mendes (2021) were used, and the study she carried out for the proposal of her book Feminicídio de Estado, as well as research in documentary articles on the rate of violence against women, the IPE AND ATLAS OF VIOLENCE and in Brazilian legislation such as the use of Laws No. 11,340/2006 and No. 14,994/2024.
