LEGAL NON-COMPLIANCE AND THE NEED FOR IMPLEMENTATION OF THE RIGHT TO THE CITY IN BRAZIL

The Right to the City is a theme that serves as a precept to protect several fundamental rights, such as the right to security, housing and an ecologically balanced environment, among other principles protected by the Constitution. This paper aims to expose the legal non-observance of the Right to the City, as well as to construct a concept on the topic addressed. Furthermore, the qualitative method was employed, through bibliographic research, using Brazilian standards, doctrinal sources and interviews to construct the article. In view of the facts analyzed, it is understood that the Right to the City, at the national level, has numerous standards that aim to guarantee the effectiveness of human dignity in its various aspects; however, in the sphere of normative enforcement, challenges are faced.
