This scientific article aims to reflect on the relevance of the participation of lawyers in the Small Claims Courts, due to their legal standing to act before the judicial system. The litigation by individuals without such capacity often imposes limitations on access to justice, a fundamental right guaranteed by the Federal Constitution of 1988.
