LAW NO. 14,133/2021 AND ITS IMPACT ON SPEED AND TRANSPARENCY IN PUBLIC PROCUREMENT

Public procurement plays a central role in the structure of Brazilian Public Administration, functioning as an essential mechanism to ensure contracts based on legality, efficiency, and the public interest. In this context, the enactment of Law No. 14,133/2021 introduced a new regulatory framework for government contracting, aimed at modernizing procurement procedures and promoting greater transparency, speed, and administrative autonomy.This study aims to analyze the impacts of Law No. 14,133/2021 on public procurement, with emphasis on the principles of transparency, celerity, and administrative autonomy. The new law, which gradually replaces the previous legal framework, represents a normative and institutional advancement by modernizing public contracting procedures, consolidating governance guidelines, and fostering greater efficiency in the performance of Public Administration. Initially, the concept and function of Public Administration are presented, along with its objectives and constitutional foundations, highlighting its social function and guiding principles. The research also addresses public procurement as a fundamental administrative procedure for the acquisition of goods, services, and works, relating it to the principles of legality, impersonality, and the supremacy of the public interest.
The analysis also includes the main changes brought by the new law, especially the implementation of the National Public Procurement Portal (PNCP), the prioritization of electronic bidding, the introduction of competitive dialogue, and the strengthening of planning in public contracts. It is concluded that Law No. 14,133/2021 contributes decisively to the institutional strengthening of the Brazilian State, ensuring greater social control, administrative rationality, and effectiveness in the provision of public services.
