BURNOUT IN ON-CALL EMPLOYEES: THE CONSEQUENCES OF THE SYNDROME AND THE NECESSARY PREVENTION MEASURES

Burnout Syndrome, characterized by physical and emotional exhaustion resulting from the work environment, has become increasingly common among workers subjected to exhausting working hours, pressure for productivity, and adverse conditions in the exercise of their duties. This article analyzes the concept of the syndrome from a labor legal perspective, based on Brazilian legislation, doctrine and recent jurisprudence. It addresses the employer's responsibility, the classification of the disease as a work accident and the rights of the affected worker. It is concluded that Burnout Syndrome is a reality that requires the employer to take effective actions to prevent and promote mental health at work, under penalty of civil and labor liability. The protection of the worker necessarily involves the adoption of more humane and legally appropriate organizational practices.
