This paper analyzes the right to a name and identity of indigenous peoples, based on theoretical, bibliographical, and normative research, highlighting the existence of specific legal systems among indigenous communities and the way in which these systems regulate internal cultural and social aspects. It addresses the difficulty of registering indigenous names in accordance with their languages and traditions, highlighting the legal and social invisibility to which they are subjected, in violation of international treaties and Brazilian legislation. In addition, it examines ethnic recognition and the importance of the name as an element of cultural identification, in light of the Federal Constitution of 1988, which breaks with the integrationist logic and recognizes the right of indigenous peoples to maintain their identity. Finally, it emphasizes the importance of guaranteeing this right as an essential tool for the realization of citizenship and the preservation of the memory and existence of these peoples.
