TELECOMMUNICATIONS LAW AND CRIMES UNDER BRAZILIAN LEGISLATION

This article sought to discuss the importance of the right to communication as a fundamental element for the exercise of citizenship and the need for its protection in the face of the challenges posed by the digital environment. The research aimed to analyze the role of the National Telecommunications Agency (ANATEL) in preventing and combating digital crimes, considering its regulatory and supervisory role in telecommunications services in Brazil. The methodology used was bibliographic and documentary research, based on legislation, academic publications and institutional reports. The results showed that, despite technological advances and greater access to information, there is a significant increase in virtual crimes, such as fraud, scams, data leaks and disinformation. ANATEL has adopted important measures, such as blocking signals in prisons and combating the activation of fake lines, but it still faces challenges in the face of the speed of digital innovations. It is concluded that it is essential to strengthen the agency's performance, expand cooperation between public institutions and invest in digital education to ensure a safe, ethical and accessible communication environment for all.
