THE SERVICE FOR ASSISTANCE TO INDIVIDUALS IN CUSTODY AT THE OLINDA-PE FLAGRANTS CENTER: AN ANALYSIS IN THE LIGHT OF CRITICAL CRIMINOLOGY

Abstract

The present study aims to analyze the foundations and relevance of the social protection service in custody hearings at the Central de Flagrantes of Olinda-PE, as well as what the personal and social indicators of the individuals assisted reveal in light of critical criminology. This procedure seeks to enforce constitutional rights and guarantees for people in vulnerable situations, as outlined in Resolution 213/2015 of the National Council of Justice. Additionally, it addresses the criminal system and critical criminology, notably through the perspectives of Michel Foucault, Alessandro Baratta, Juarez Cirino dos Santos, Vera Malaguti Batista, Guilherme de Souza Nucci, Sérgio Salomão Shecaira, Antonio Garcia Pablos de Molina, Luiz Flávio Gomes, Salo de Carvalho, among others. The study then problematizes prison overcrowding and its impact on Brazilian society and our penal system. Consequently, it also aims to present a debate on the creation of custody hearings, their foundations, and the expected outcomes for the problem of prison overcrowding in Brazilian correctional facilities, as well as the enforcement of constitutional guarantees and human rights. Finally, the study seeks to present a database developed from information collected from the services provided at the Central de Flagrantes of Olinda-PE, which reveal relevant social factors for the country's incarceration policies. Thus, it is concluded that the social protection service in custody hearings generally contributes significantly to the humanization of the penal system, while also offering more effective support to detainees. Moreover, the social indicators collected form a stereotype shared by repressive agencies, reflecting a highly segregational policing pattern. All this is based on bibliographic research, which grounded the theoretical framework selection in critical criminology, and on the qualitative collection and analysis of data extracted from the Central de Flagrantes of Olinda-PE database from January 2022 to June 2024, highlighting the sample used in this study regarding the importance of custody hearings in the humanization of incarceration policies in Brazil.
