VIOLENCE AGAINST WOMEN IN THE DOMESTIC AND FAMILY SPHERE

This article sought to discuss domestic and family violence against women, which persists as a serious human rights violation in Brazil, despite the legislative advances consolidated by Law No. 11.340/2006, commonly known as the Maria da Penha Law. The multiple facets of this physical, psychological, sexual, property and moral violence will be analyzed, and the legal mechanisms for punishment, cessation and prevention will be discussed. We will also investigate the profound consequences that affect not only women, but also their partners. A qualitative methodology was adopted, with a deductive approach and bibliographical research, based on an analysis of Brazilian legislation, legal doctrine and academic literature. The results show the complexity of the phenomenon, the crucial importance of the Maria da Penha law and its updates, and the need for immediate and effective responses from the justice system. The insufficiency of purely punitive approaches is discussed, arguing for the indispensability of robust preventive strategies, social awareness and the strengthening of support networks. The conclusion is that effectively tackling domestic violence requires integrated and multi-sectoral action, focused not only on protecting the victim, but also on deconstructing cultural patterns and interrupting the intergenerational cycle of violence, with a view to building a fairer and more equal society.
