The Continuous Benefit Payment (BPC) is a right guaranteed by the Federal Constitution of 1988 and regulated by the Organic Law of Social Assistance (LOAS), intended for people with disabilities and elderly people in situations of socioeconomic vulnerability. However, access to this benefit faces significant challenges, such as excessive bureaucracy, restrictive eligibility criteria and delays in analyzing applications. This study aims to analyze the main obstacles faced by BPC beneficiaries, identifying the structural and administrative difficulties that compromise the granting of the benefit. To this end, a bibliographical research was carried out based on legislation, legal doctrines and academic studies on the subject. The results indicate that the lack of accessibility in the application process, the requirement of complex documentation and frequent judicialization are factors that hinder access to BPC. It is concluded that the debureaucratization of the system, the modernization of administrative processes and the expansion of assistance policies are fundamental to ensure that the benefit reaches those who really need it, promoting greater social inclusion and ensuring the rights of citizens.
