ETHICAL AND PRIVACY CHALLENGES IN THE USE OF ARTIFICIAL INTELLIGENCE IN THE BRAZILIAN JUDICIARY

This article sought to describe the ethical and privacy challenges of using artificial intelligence in the Brazilian judiciary. AI has increasingly demonstrated its great potential to revolutionize the way legal processes are directed, resulting in efficiency and automation for repetitive and complex tasks. However, the use of this technology also raises questions about ethical and privacy challenges, especially with regard to the processing of sensitive data and the impartiality of automated decisions. The results demonstrate the use and knowledge of artificial intelligence in the Brazilian judiciary. It delved into ethical challenges, the principle of dignity, implications, responsibilities, transparency and the problem of “black boxes”, the issue of algorithmic impartiality, fairness and combating bias. Human supervision, the limits of automation, privacy in the use of artificial intelligence and a brief overview of Brazilian and international legislation on AI. Using a qualitative approach, we discuss how artificial intelligence can amplify existing biases and compromise individuals' privacy. We conclude that, although AI brings significant benefits, it is a priority to establish regulatory frameworks that guarantee ethics and privacy in the use of AI, resulting in transparency, fairness and the protection of fundamental rights.
