SISTEMA PRISIONAL BRASILEIRO E O CUMPRIMENTO DA LEI DE EXECUÇÃO PENAL FRENTE AOS DIREITOS E DEVERES DO PRESO – REVISÃO 2021

Abstract

                                                                                                                                          This study analyzes the problems and conditions facing the prison system in Brazil. Data were sought for local analysis, on the Regional Prison of Santa Cruz do Sul, Rio Grande do Sul, registered in 2013, ending with a comparison to the present day 2021. As the main framework, the basis was the Criminal Execution Law (Law 7,210 /84), with a view to the rights and duties of prisoners, as well as other legislation dealing with the subject, in addition to a bibliographic study by renowned authors. The aim of this work is to identify and expose as much as possible what is right and/or wrong in the country's prison system. For analysis of the indicated subject, the method of qualitative and quantitative approach was used, with a descriptive character, in order to allow a better understanding of the issues presented. Therefore, this work is worth considering the need for discussion and dissemination of such an important subject that always involves and affects the entire society, highlighting the final perspective that an adequate fulfillment of the deprivation of liberty sentence is achieved, and that everyone benefits.
