The National System of Public Policies on Drugs, established by Law No. 11,343/2006, together with the criminal procedure applied according to article 28 of the aforementioned law, prescribes measures for the prevention of misuse, care and social reintegration of drug users and addicts. These measures include warnings about the effects of drugs, provision of services to the community and participation in educational programs or courses. In addition, verbal counseling by the judge and even the imposition of a fine on the user or addict who refuses, without justification, to comply with the educational measures imposed. It is analyzed that the new law complies with legal objectivity, while at the same time treating drugs as a public health problem that requires specific treatment. However, the intervention of a complementary system is necessary in search of a new paradigm through Restorative Justice.
