This article aimed to analyze the right to health, provided for in the 1988 Constitution, seeking to identify the main challenges and perspectives involved in its implementation. From a bibliographical review that included academic articles, legislation, resolutions, ordinances and the 1988 Federal Constitution, it was found that, despite the advances promoted by the SUS, universal and equal access to health has not yet been fully guaranteed. Among the main challenges include inequality in the distribution of resources, the precariousness of infrastructure in remote areas and the barriers faced by vulnerable groups. Therefore, the continued commitment of the Ministry, the State and Municipal Health Secretaries and the supervisory bodies is essential to ensure that the SUS remains an inclusive, efficient and effective system, in accordance with the principles of universality, equality and integrality set forth. in the Brazilian legal system.
