This work addresses the legal and social helplessness of people interdicted as a result of mental illness, seeking to understand its causes and consequences, identify gaps in the legal and social systems and propose measures to promote more effective protection of their rights and interests. The research was conducted using a qualitative approach, involving a literature review. The results revealed the inadequacy of existing systems, highlighting gaps in guardianship, access to mental health services and the fight against stigma, contributing to the exclusion and suffering of these people. In short, the implementation of integrated policies that guarantee universal access to mental health services, combat stigma and promote a culture of inclusion are fundamental to mitigating the legal and social helplessness of those interdicted due to mental illness, respecting their rights and promoting their well-being. -be.
