AUTOCRACY: THE FEDERAL SUPREME COURT BEYOND ITS LIMITS

This article discusses judicial autocracy in Brazil, analyzing the role of the Federal Supreme Court (STF) and its possible extrapolation of functions. Judicial autocracy occurs when the Judiciary assumes an excessive role in defining public policies, compromising the democratic balance. The STF has a fundamental role in protecting the Constitution, but its actions must be examined in light of democratic principles. Transparency, citizen participation and interinstitutional dialogue are essential to maintain the legitimacy of the Judiciary. The fake news inquiry, initiated by the STF, generated criticism for its way of conducting and possible excesses. The investigation was considered prior censorship and a violation of the principle of contradictory and broad defense.
