THE REGULATION OF SPORTS BETTING IN BRAZIL: LAW NO. 14,790 OF DECEMBER 29, 2023

Abstract

With the advancement of technologies and the growing popularity of internet use in Brazil, gaming and betting activities, previously carried out preferably in person, began to be carried out virtually, through online betting houses and their applications. With the ease of bidding on various sporting events, in numerous sports and other countries, there has been an increase in so-called sports betting, accepted in the legal system, as it has different regulations than gambling. Despite being accepted, there were still questions about the legality of these activities, especially regarding the liability of these “bets” for losses suffered by bettors. As necessary, there were already some rules aimed at regulating sports betting, but they were recently revoked with the sanction and entry into force of Law no. 14,790, of December 29, 2023. In view of legal innovation, this article has the general objective of presenting the main provisions of the new law and analyzing its application in jurisprudence and the most relevant doctrinal notes, prepared according to the qualitative research methodology, object of bibliographical research.
