FAKE NEWS IN THE LIGHT OF CRIMINAL AND CIVIL LAW

This article is focused on a theoretical study that addresses the topic of Fake News in the light of Criminal Law and Civil Law. Aspects such as the damage and consequences caused by the spread of Fake News and the applicable penalties within the Civil and Criminal spheres are raised. It discusses what is new in Brazilian legislation regarding punishment for creators and propagators of Fake News, as well as which crimes can constitute Fake News. The elaboration of this study is necessary because it is approached in a technically legal way, where personal opinions or ideologies of any kind on the subject do not interfere with the study and the information is treated in an explicit and didactically explanatory way to form an informative vision that will add, in the midst academic and social, the difference in the concept of damage caused by Fake News and the responsibility of those practicing such acts. It has been observed that fake news tends to cause all types of harm to society as a whole, there are thousands of untrue information circulating through digital media every day that cause various harm to people.
