Abstract

The present article carries out a brief comparison between the list of fundamental rights and guarantees established in the Brazilian Constitution of 1988 and in the Spanish Constitution of 1978. It is a research that uses a descriptive methodology, fundamentally based on legislative and jurisprudential investigation. The study aims to ascertain the differences between the two systems and, in the end, propose the improvement of the national system for the protection of human rights.
