CIVIL LIABILITY FOR AFFECTIVE ABANDONMENT OF PARENTS

Throughout the development of individuals, several factors can influence affective damage. In the family context, the influence of negligent parental care or its absence stands out, which can trigger harm to the development and well-being of children. Affective abandonment, in this context, can result in physical, emotional and psychological problems in the child, both transiently and lastingly throughout life. Thus, the general objective is to investigate the scope of civil liability in the relationship between parents and children, arising from emotional abandonment and specific objectives to analyze the concept of emotional abandonment and the causes that lead parents to commit this type of illicit act; describe the consequences of emotional abandonment for children and adolescents, identify the applicable penalties in light of the legal field and the applicable punishments for parents who practice emotional abandonment. To achieve these objectives, a qualitative bibliographic review was adopted as a methodology, as the intention is not to measure data, but only to read, interpret and analyze authors who have researched the subject and can contribute to a better understanding of the issue of emotional abandonment and civil liability borrowed from books, articles published in scientific journals and Brazilian legislation. It was concluded that parental emotional neglect not only affects the immediate well-being of the child, but can also leave deep emotional consequences that last throughout their adult life and that civil liability can be a remedy for this damage. be minimized. In this way, the importance of imposing responsibilities on parents who neglect the emotional care of their children is recognized, not only as a punitive measure, but also as a way of promoting the protection and well-being of children.
