This research analyzed the emergence of constitutionalism and its development in civilization. The change from a Legislative State of Law to a Social State of Law that would give rise to neoconstitutionalism and the strengthening of Constitutions. This study also deals with the right to health and the reasonable duration of the process for its realization, supported by international treaties, and how the American Convention on Human Rights contributed to the progress of the fundamental right to health, stimulating its provision within a reasonable and aiming to promote social justice.
