CONTRACTING AGENT AND HIS RESPONSIBILITY AS IMMEDIATE MANAGER OF THE BIDDING PROCESS

The present work seeks to understand the responsibility of the contracting agent within a bidding process, in order to ensure the best proposal capable of generating the most advantageous contracting outcome for the public administration and satisfaction of the public interest. For this purpose, the concept of public servant, their legal framework, and their assumptions of responsibility were studied, as well as the bidding process before Law 14,133/21 and the establishment of the contracting agent as the manager of the bidding process were analyzed through a comparative study between the old bidding law and the current new bidding law, constitutional norms, and specialized doctrine. The method used in this research was deductive, with a qualitative approach, through a bibliographic review study and analysis of bidding regulations. It is concluded, therefore, that the responsibility of the contracting agent is individual, and they may be held accountable in various spheres for the conduct of the bidding process, thus being detrimental to public administration.
