MEDIATION OF FAMILY CONFLICTS IN LAW: AN EMANCPATORY PRACTICE IN THE BRAZILIAN REALITY

The purpose of this work is to analyze the application of mediation as an alternative for resolving conflicts within the scope of family law. To the extent that family demands must be approached with great caution, due to the bond existing between the parties involved, since, in family conflicts, the possible emotional overloads of these subjects are manifested. Therefore, the project also works to reestablish communication between those involved in the legal relationship, seeking to complement their actions, as far as possible to resolve conflicts. The way in which mediation can bring about these resolutions was also discussed, in a way that concludes agreements that bring mutual benefits, making the process less time-consuming, due to many processes that are being processed in the judiciary, awaiting solutions that can be resolved peacefully, in addition, the parties can dialogue, assisted by a mediator who is an impartial being. In this sense, the development of the study is based on bibliographical research, carrying out a survey especially in books, university libraries and scientific articles.
