THE ETHICAL PERFORMANCE OF LEGAL PROFESSIONALS IN THE CURRENT SCENARIO IN BRAZIL

The ethics of legal professionals in Brazil are based on principles that aim to ensure integrity, impartiality and justice in their actions. These principles are established by the Statute of Advocacy and the Brazilian Bar Association (OAB) and by the OAB Code of Ethics and Discipline. Legal professionals must act in accordance with Brazilian legislation and the Federal Constitution, ensuring the fair and equitable application of the Law, always respecting the secrecy of communications and confidential information received from their clients, protecting their privacy and interests. The ethics of legal professionals in Brazil involve respect for the law and the Constitution, independence and impartiality in professional performance, confidentiality of confidential information, competence and diligence in the exercise of the profession, loyalty and transparency in professional relationships, respect to contradictory and broad defense, and the commitment to social responsibility and the fight against corruption. To this end, the present study aims to expose the ethical performance of legal professionals in the face of the current Brazilian scenario, which is so conflicting with regard to the exercise of legislation. For this, the research was based on an extensive bibliographical review that included important scientific articles, government reports, books and academic documents dating from 1990 to 2024, which seeks to point out ethics not only philosophically, but as a guide to professional conduct.
