THE LOW EFFECTIVENESS OF PARTICIPATORY DEMOCRACY INSTRUMENTS IN BRAZIL

The objective of the study is to analyze the effectiveness of this instrument of direct participation, focusing on the Brazilian legal system, in article 14, items I, II and III of the Federal Constitution of 1988, three mechanisms can be extracted: plebiscite, referendum and popular initiative. In this sense, the article portrays a bulletin of the introductory concepts of the etymological and historical formation of democracy, providing a reflection on the origin of contemporary systems of popular participation. Next, the essential elements of the three constitutional regimes in the globalized context are good: representative or indirect democracy, direct democracy or semi-direct democracy and participatory democracy. The work concludes by specialization each of the mechanisms of direct democracy adopted by Brazil, verifying the relevant issues of the historical, conceptual, legal provision and social effectiveness composition. As a result of the analysis, it is essential for the advancement of the Brazilian democratic model, the development of more objective infra-constitutional legislation, the political awareness of parliamentarians about the importance of sharing the decision-making power of the state and the development of programs aimed at encourage popular participation.
