THE EFFECTIVENESS OF BUSINESS MEDIATION IN JUDICIAL RECOVERY: A CASE STUDY IN BRAZIL

Abstract

The present work addresses mediation in the business context, specifically within the framework of the judicial recovery process based on Law 11.101/2005, with the objective of analyzing the mediation process in business law as an important tool for the judicial recovery process. To achieve this, a case study method was employed in conjunction with bibliographic research. The results obtained revealed how the application of business mediation influences the judicial recovery process of companies in terms of effectiveness, efficiency, and compliance with the law, as well as the importance of distinguishing the roles of mediator and administrator before the court. Therefore, it is evident that mediation allows for the preservation of important relationships, facilitating communication between the parties during the process so they can work together after the recovery.
