PESTICIDES IN AGRICULTURAL AND ENVIRONMENTAL LAW: AN ANALYSIS OF REGULATORY STANDARDS IN 2023

Agriculture is one of the main Brazilian economic activities, essential mainly for the population's food security, being the livelihood mechanism for thousands of rural producers, taking Brazil to a significant level of exports of agricultural products. On the other hand, the country stands out negatively due to the excessive use of pesticides, a factor that is highly questioned, since an excess of these products can cause irreversible damage to the environment and human health. As this is a controversial topic, this work presents the legal standards that regulate the use, manufacture and registration of pesticides in the national territory, as well as the standards that involve the application of these products as an object of regulation by both federal and state legislation. , with emphasis on the New Pesticides Law, sanctioned in December 2023, responsible for adapting legal provisions, increasing the legal rigor of inspection, production, commercialization and final destination of pesticides. The research was prepared using the bibliographical research technique and the literature review method, and begins with contextualization on the legal regulation of pesticides in Brazilian Law; indicates the debate about damages; Finally, the regulations in force in the country are presented, concluding with an explanation of the laws that regulate pesticides and the way in which permission is granted for their regular use in agriculture.
