LIMITS OF PRIVATE AUTONOMY ON THE EXERCISE OF PERSONALITY RIGHTS

This scientific article critically analyzes the limits of private autonomy in the context of the exercise of personality rights within the scope of civil law. In short, the nature of the problem lies in the tension between individual freedom of self-determination and the collective and social interests that can be affected by this autonomy. The study exposes that, although private autonomy is crucial for consolidating the freedom of being, it is not unlimited, especially when it collides with one's own personality rights or fundamental interests of society.
