Abstract

The study's central issue is the fundamental rights of the homeless population of Cracolândia as opposed to public security measures that may violate the human dignity of these individuals. This study is guided by the general objective of analyzing the situation experienced by the homeless population of Cracolândia in relation to the fundamental rights of human dignity and public safety. The methodology used was supported by the deductive method with bibliographic and documentary research techniques, considering that already published content, laws and jurisprudence were observed. Among the results achieved, it was demonstrated that the lack of decent housing for the population of Cracolândia represents a failure by the municipality of São Paulo/SP to provide the minimum necessary for life with dignity as established in Law No. 14,821/2024. It was concluded, then, that the municipality of São Paulo cannot prioritize the safety of other citizens by imposing restrictions such as compulsory hospitalization, as this measure violates the dignity of the human person, since the right to public safety also reflects about the homeless population of Cracolândia.
