Abstract

This article aims to analyze media interference in criminal proceedings, focusing on the Escola Base Case, one of the most categorical errors in the actions of the press and the Civil Police of the State of São Paulo. To this end, a historical analysis of the media was carried out during the period of the civic-military dictatorship and how the press produced information during the validity of the institutional acts that lasted throughout this period. Next, we associate this conduct with three principles of Law that are vilified with the spectacularization of the cases in evidence: (a) Dignity of the Human Person, (b) Presumption of Innocence and (c) Contradictory, emphasizing the effectiveness of the latter. Next, we associate this conduct with three Further, the relationship between the sentencing pre-judgment and media influence is established, influencing the opinion of society and the judge regarding the selected case. Finally, the article exemplifies through Escola Base how the press interferes in the public construction of opinion. In this context, it was concluded that journalistic coverage must occur within values ​​and parameters compatible with the investigation of facts in the generation of news.
