The National Association of Natural Persons Records showed that the number of children abandoned by their parent while still in the mother's womb exceeded one hundred thousand in the first seven months of 2023. The 2015 Civil Code, despite not specifically providing for emotional abandonment, presents us with civil liability, which consists of the obligation to repair property or moral damage caused to others. Thus, the main objective of this article is to analyze the possibility of monetary compensation for victims of emotional abandonment by their parents, through Civil Liability, as well as to verify how doctrine and jurisprudence are treating the topic. The study was carried out through descriptive research, the work used bibliography, information, as well as doctrines and jurisprudence.
