Abstract

This article seeks to understand how football legislation addresses racial issues, and how it acts to regulate the issues inherent in sport, given the existence of a private legal system that produces norms and has its own principles. Firstly, an analysis is made of how the insertion of players of black and peripheral origin into Brazilian football took place and the historical retrospective of racial discrimination. Then there is an approach to the creation, structuring and applicability of sports legislation on racial issues and how the racial prejudice experienced in Brazilian society and the institutionalization of racism in the legal system is responsible for the manifestations of violence and intolerance in Brazilian sport. Lastly, a list of notable cases of Racial Discrimination in Sport.

Graduado em Direito pelo Centro Universitário de Ensino Superior do Amazonas – CIESA (2005), Especialista em Direito Público pela Universidade Gama Filho (2007), Mestrado (2012) e Doutorado (2019) em Ciências Sociais - Política, pelo Programa de Pós-Graduação em Ciências Sociais pela Pontifícia Universidade Católica de São Paulo (PUC-SP). Atualmente é docente do quadro efetivo da Universidade Federal do Amazonas lotado na Faculdade de Direito.
