Abstract

The article discusses the issue of criminalization of marijuana in Brazil. To this end, we will walk through the history of cannabis in Brazil, using arguments that question the legitimacy of the prohibitionist discourse in controlling the use of marijuana. Thus, we will analyze the genealogical approach of Michel Foucault's Philosophy as a valuable and multidisciplinary tool, considering various social, political, economic and cultural factors to investigate the criminalization of marijuana. The conclusions point to the illegitimacy of the criminalization of cannabis use and the understanding of the dynamics underlying criminalization in the Brazilian context.
