THE REFLECTION OF THE APPLICATION OF HUMAN RIGHTS ON THE MOST VULNERABLE POPULATION

Abstract

The protection of human rights gained momentum after the Second World War, when debates on the topic intensified and the need for its implementation became apparent. This is so true that new international organizations have emerged to act in this sense, with emphasis on the American scenario being the Inter-American System for the Protection of Human Rights, made up of the Commission and the Inter-American Court of Human Rights. The two bodies have been playing an important role, through advisory opinions, recommendations, promotion of human rights and also through contentious cases judged by the Court. This stands out even more when the protection of minorities and vulnerable groups is at stake, who, not infrequently, find themselves helpless internally, finding refuge through international mechanisms. It turns out that there is little debate about the terminological differentiation that exists between minorities and vulnerable groups, a differentiation that is relevant as it presents practical consequences, especially when talking about the implementation of public policies. In this way, the problem to be addressed throughout this work emerges, namely: how is the protection of groups in vulnerable situations by the Inter-American Court, based on the logic of structuring sentences? To this end, the deductive method will be used, and the work aims to demystify the existing between the lines between the two concepts (minorities and vulnerable groups), addressing the logic of the functioning of the Inter-American System, as well as the role of the Court in the which refers to structuring sentences, embodied in determining the implementation of public policies, with the aim of enriching the scope of discussion on the topic.
