Abstract

The recognition of health as a fundamental right introduced a new dynamic in the political and social spheres, generating significant repercussions. Previously, demands for improvements in health conditions were predominantly directed at the executive and legislative branches. However, the elevation of the status of health as an essential right has paved the way for the possibility of seeking intervention through the judicial system. To improve the performance of judicial experts, it is advisable that the judge responsible for the Court schedules and conducts meetings with the experts. This approach allows the expert work to be improved, ensuring that it is solid and supported by technical-scientific arguments based on the elements contained in the records. Therefore, the importance of effective communication between the judge, experts and the parties stands out, being essential for medical professionals to understand the function of expert evidence and carry out a more insightful assessment that is closer to the reality of the expert, without inconsistencies.
