This article analyzes the possibility of using the social assistance benefit as a way out of homelessness, based on the Claim of Breach of Fundamental Precept (ADPF) 976. In conjunction with public policies that aim to ensure the right to housing first and other fundamental rights of homeless people and based on the three fronts established in the APDF as priorities and stages to be tackled for public policies aimed at homeless people, we will analyze how the social assistance benefit, guaranteed by the Federal Constitution, can be a way out of social vulnerability. We will also discuss the state's and society's aporophobia, which necessarily needs to be overcome in order to solve or mitigate the social problem that is the growth of the homeless population in our country, with the aim of bringing dignity to the people on the streets and seeking to eradicate poverty and reduce social inequalities.
