MILITARY POLICE AND THE CHALLENGES TO FULFILLING ITS ROLE IN PUBLIC SECURITY: THE GUARANTEE OF THE DEMOCRATIC RULE OF LAW

In any State of Law, the police function has a broad field of action on the issue of security. The strategies and forms that each government implements in relation to its law enforcement agents have a direct impact on the safety of citizens. Therefore, before the specific analysis of the police function, security must be understood from the perspective of human rights, that is, as a vital minimum that requires concrete measures to guarantee it. Constitutions contain the fundamental and, most often, supreme law of the state, and the rule of law dictates the application of these principles above all other laws. Thus, the objective of this article is to summarize evidence about the democratic rule of law in relation to public security and the role of the Military Police. The research was outlined in a literary review of books and articles that have high impact factors, national specialized journals and doctrines. We sought to present the history of the Military Police and its forms of action, how the police defend the Democratic Rule of Law, police ethics, police action based on human rights, maintenance of public order and safeguarding democratic freedoms, responsibility police and transparency and issues of police organization and management.
