HOUSE ARREST AND THE NEED FOR ADJUSTMENT FOR THE IMPRISONED WOMEN

The need to convert prison to house arrest for women prisoners is necessary to guarantee and secure various rights, from essential legal assistance to their basic subsistence conditions. This work seeks to study the main situations of possibility of the applicability of house arrest to women prisoners, aiming to discuss the possibility of expanding the use of the institute in compliance with constitutional precepts, especially human dignity, refuting the forced separation between mothers and their children and family members. The research method used is bibliographic analysis where existing literature was used combined with data from different research groups, we elucidated the situation of women imprisoned in Brazil. The work was structured into two chapters. The first addresses, The historical concept and origin of house arrest in Brazil. The second brings the possibilities of house arrest for the incarcerated woman. In the end, it is concluded that it is necessary for the judiciary to give visibility to the problem, thus increasing approvals in favor of converting preventive detention to house arrest, with the aim of expanding the possibilities of granting this regime progression, including some cases not expressly provided for in laws.
